Eligibility and Account

• Access and purchases are permitted only to persons competent to contract under the Indian Contract Act; accounts must contain accurate information and not be shared or misused.
• Account holders are responsible for safeguarding login credentials and all activities under their account, and Forge3D may suspend accounts for suspected fraud or policy violations consistent with Indian e-commerce norms.

Product Listings and Custom Orders

• Product images, specifications, materials, layer heights, tolerances, and lead times are indicative; minor variations may occur due to additive manufacturing processes and material batches, which is standard for 3D printing services.
• For custom orders, users confirm rights to any uploaded 3D files, CAD models, or design instructions and grant Forge3D a limited license to print and fulfill the order; delivery timelines begin after final file approval and payment confirmation.

Pricing, Taxes, and Payment

• Prices are listed in INR and are inclusive/exclusive of GST as indicated at checkout; applicable taxes and shipping charges are shown before payment per Indian e-commerce disclosure expectations.
• Secure payment is processed via approved gateways; orders are confirmed only upon successful payment authorization, and Forge3D may cancel and refund transactions affected by pricing errors or suspected fraud in line with fair practice principles.

Shipping, Delivery, and Risk

• Shipping methods, charges, and estimated delivery timelines are displayed at checkout; delays due to courier constraints, force majeure, or address issues may occur and will be communicated where feasible as per consumer transparency norms.
• Title and risk pass to the customer upon delivery scan by the carrier; any visible damage should be noted with the courier and reported to Forge3D within 48 hours for assistance under standard dispute resolution practices.

Returns, Replacements, and Cancellations

• Standard products: Eligible for returns/replacements within the stated return window if unused and in original packaging, subject to inspection; refunds are processed per the original payment method in line with Indian consumer protection guidance.
• Custom-made items: Because custom prints are made-to-spec, they are generally nonreturnable; however, Forge3D will replace or reprint for manufacturing defects or dimensional errors beyond agreed tolerances if reported within 7 days with photos and order details.

Content and Intellectual Property

• All site content (logos, photos, texts) is owned by Forge3D or licensors and protected under applicable IP laws; no reproduction or commercial use is allowed without prior written consent.
• Users warrant that uploaded custom files do not infringe third-party rights; Forge3D may refuse, cancel, or remove infringing content to comply with law and platform integrity expectations.

User Conduct

• Prohibited uses include unlawful activity, IP infringement, harmful code, data scraping, and activities that impair site functionality; violations may lead to account termination and legal remedies consistent with Indian IT and platform norms.
• Reviews or submissions must be accurate and non-deceptive; Forge3D may moderate or remove content that violates law or policy in keeping with responsible e-commerce practices.

Privacy and Data Protection

• Personal data is processed per the Privacy Policy and India’s Digital Personal Data Protection Act (DPDP Act) principles, including valid consent that is free, specific, informed, unconditional, and unambiguous via clear affirmative action, with simple withdrawal mechanisms.
• Cookie notices, consent records, and grievance mechanisms are maintained in line with DPDP consent and notice obligations and emerging consent management architecture guidance in 2025.

Consumer Disclosures

• Pre-contract disclosures include pricing, taxes, delivery, returns, warranty (if applicable), and grievance contacts, consistent with Indian consumer protection and e-commerce transparency expectations in 2025.
• No pre-ticked checkboxes for consent or add-ons; explicit consumer consent is required for optional services and marketing in line with BIS draft self-governance guidelines and DPDP requirements.

Warranties and Disclaimers

• Except as expressly stated, services and products are provided “as is” and “as available”; implied warranties are disclaimed to the fullest extent permitted by applicable law, with statutory rights preserved under Indian consumer law.
• Functional suitability of custom designs is the customer’s responsibility; Forge3D does not warrant performance for end-use beyond agreed specifications unless expressly confirmed in writing.

Limitation of Liability

• To the maximum extent permitted by law, Forge3D’s aggregate liability for claims arising from orders or site use is limited to the amount paid for the affected order, excluding indirect or consequential losses, consistent with standard e-commerce terms in India.
• Nothing limits liability for fraud, willful misconduct, or other liabilities that cannot be limited under Indian law.

Indemnity

• Users agree to indemnify Forge3D, affiliates, and personnel against claims arising from user content, custom files, misuse of the site, or breach of these Terms, subject to applicable Indian law

Compliance and Platform Governance

• Forge3D maintains grievance redressal and contact details and will cooperate with lawful requests under applicable IT and consumer frameworks, while avoiding unfair trade practices and maintaining transparent policies in line with 2025 updates.
• Where applicable, Forge3D will align with sectoral or BIS self-governance guidelines for ecommerce, including explicit consent norms and fair disclosures as they evolve in 2025.

Suspension and Termination

• Forge3D may suspend or terminate access or cancel orders for suspected fraud, IP infringement, policy violations, or non-payment, with refunds as applicable; repeated violations may result in permanent bans to protect platform integrity

Governing Law and Dispute Resolution

• These Terms are governed by the laws of India; courts of the chosen city/state of Forge3D’s registered office shall have exclusive jurisdiction, without prejudice to consumer statutory remedies available under Indian law
• Parties will attempt amicable resolution first via the grievance mechanism before formal proceedings, reflecting recommended dispute resolution practices for e-commerce.

Changes to Terms

• Forge3D may update these Terms to reflect legal, operational, or security changes; continued use after notice constitutes acceptance, and material changes will be communicated per transparency best practices in India’s evolving e-commerce regime.
